These Terms of Service (“Terms”) govern your access to and use of the WordSmirk™ website, online store, products, customer accounts, features, content, and related services (collectively, the “Services”).

Throughout these Terms, “WordSmirk™,” “we,” “us,” and “our” refer to WordSmirk™ and/or the legal entity that operates the WordSmirk™ store. “You” and “your” refer to any person who accesses, browses, purchases from, creates an account with, or otherwise uses the Services.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer products and Services to you.

By visiting our website, creating an account, purchasing a product, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Online Store Terms

You may use WordSmirk™ only for lawful purposes and in accordance with these Terms.

By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have obtained any legally required permission from a parent or legal guardian.

You may not use our products or Services for unlawful or unauthorized purposes or violate applicable laws through your use of WordSmirk™.

You may not transmit viruses, malware, malicious code, or other technology intended to damage, disrupt, intercept, or interfere with the Services.

2. Products and Merchandise

WordSmirk™ sells apparel, accessories, merchandise, and other products featuring words, definitions, illustrations, humor, commentary, artwork, and other creative content.

We make reasonable efforts to display products accurately. However, the colors and appearance of merchandise may vary depending on your monitor, device, display settings, manufacturing process, garment material, printing method, and other factors.

Product photographs, mockups, illustrations, and lifestyle images may be digitally created, enhanced, composited, or otherwise used for illustrative purposes.

Actual products may therefore vary somewhat from images displayed on our website.

3. Print-on-Demand and Made-to-Order Products

Some or all WordSmirk™ merchandise may be produced on demand after an order is placed.

Products may be manufactured, printed, packaged, fulfilled, or shipped by third-party production and fulfillment partners.

Minor variations in print placement, dimensions, color, texture, garment construction, or appearance can occur as a normal part of apparel and print production.

Such minor manufacturing variations are not necessarily considered defects.

4. Product Availability

All products are subject to availability.

We reserve the right to discontinue, modify, replace, limit, or otherwise change products at any time without prior notice.

We may limit quantities available for purchase by any person, household, account, geographic region, or order.

Placing an item in your shopping cart does not reserve the product or guarantee availability.

5. Prices

Prices displayed on WordSmirk™ are subject to change without notice.

Prices generally do not include taxes, shipping charges, customs duties, import fees, or other charges unless specifically indicated.

The price applicable to an order is generally the price displayed when the order is submitted, subject to correction of obvious errors.

We reserve the right to correct pricing, product-description, promotional, or other errors.

6. Orders

Submitting an order does not necessarily constitute our final acceptance of that order.

We reserve the right, where permitted by law, to refuse, cancel, or limit an order for legitimate reasons, including suspected fraud, unauthorized payment activity, inventory problems, pricing errors, technical errors, fulfillment limitations, suspected resale activity, violation of these Terms, or other circumstances reasonably affecting our ability to complete the transaction.

If we cancel an order after payment has been collected, we will issue an appropriate refund for the canceled portion.

7. Billing and Account Information

You agree to provide current, complete, and accurate purchase, billing, shipping, and account information.

You agree to promptly update information when necessary so that we can complete transactions and communicate with you.

WordSmirk™ is not responsible for delays, failed deliveries, or other problems caused by inaccurate information supplied by the customer, except to the extent otherwise required by applicable law.

8. Payment

Payments may be processed through Shopify Payments and/or other payment services offered during checkout.

By submitting payment information, you represent that you are authorized to use the payment method provided.

Your use of a third-party payment service may also be subject to that provider's terms and policies.

WordSmirk™ generally does not directly store complete payment-card information.

9. Taxes

Applicable sales tax, use tax, value-added tax, or similar taxes may be calculated and collected as required by law.

You are responsible for taxes, customs charges, duties, or similar governmental charges associated with your purchase unless otherwise required by applicable law or specifically stated at checkout.

10. Shipping and Delivery

Estimated production, fulfillment, and shipping times are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Shipping times may be affected by production delays, carrier disruptions, weather, holidays, customs processing, incorrect addresses, high order volumes, or circumstances outside our reasonable control.

Once an order has been transferred to a shipping carrier, delivery may be subject to that carrier's procedures and limitations.

11. Returns, Refunds and Exchanges

Returns, refunds, replacements, cancellations, and exchanges are governed by the WordSmirk™ Refund & Return Policy in effect at the time of your purchase, subject to applicable consumer-protection laws.

Because some WordSmirk™ products may be produced specifically for an individual order, certain items may not qualify for returns or exchanges merely because of a change of mind, incorrect size selection, or customer preference where permitted by law.

Products that arrive damaged, defective, materially misprinted, or incorrect should be reported according to the procedures and deadlines contained in our Refund & Return Policy.

Nothing in these Terms limits any non-waivable consumer rights provided by applicable law.

12. Promotions and Discount Codes

WordSmirk™ may occasionally offer discounts, promotional codes, sales, giveaways, or special offers.

Unless otherwise stated, promotional offers cannot be combined and may be subject to expiration dates, product exclusions, minimum purchases, usage limits, geographic restrictions, or other conditions.

Promotional codes have no cash value.

We reserve the right to modify or terminate promotions where permitted by law and to reject use that appears fraudulent, abusive, automated, or inconsistent with the promotion's terms.

13. Customer Accounts

WordSmirk™ may provide customer-account functionality.

You are responsible for maintaining the confidentiality and security of your account credentials or authentication methods and for activity occurring through your account to the extent permitted by law.

You agree to provide accurate account information and not impersonate another person or create accounts for fraudulent or abusive purposes.

Please contact WordSmirk™ promptly if you believe your account has been accessed without authorization.

We may suspend or terminate accounts reasonably believed to be involved in fraud, abuse, unauthorized activity, or material violations of these Terms.

14. Intellectual Property

The WordSmirk™ name, branding, logos, designs, graphics, illustrations, artwork, product designs, website content, photographs, videos, copywriting, definitions, humorous definitions, slogans, layouts, product presentations, and other original content are owned by WordSmirk™ or used under applicable license, except where otherwise indicated.

The WordSmirk™ name and associated branding are claimed as trademarks and/or other protected brand identifiers to the extent provided by applicable law.

Nothing in these Terms grants you ownership of or a license to use WordSmirk™ intellectual property except for the limited personal use necessary to access and shop through the Services.

You may not reproduce, copy, modify, distribute, sell, license, publish, commercially exploit, scrape, systematically download, or create derivative commercial products from WordSmirk™ content without prior written permission, except where otherwise permitted by law.

15. WordSmirk™ Definitions and Creative Content

An important part of WordSmirk™ is our creative treatment of language.

Unless expressly identified otherwise, definitions appearing on WordSmirk™ merchandise, advertisements, product pages, social media, or other content may be original, humorous, satirical, sarcastic, fictionalized, exaggerated, colloquial, or creatively interpreted definitions.

They are not necessarily intended to reproduce or replace formal dictionary definitions.

In other words, WordSmirk™ occasionally takes liberties with the English language. The English language has declined to comment.

16. Humor, Satire and Potentially Offensive Content

WordSmirk™ merchandise may contain sarcasm, satire, adult humor, irreverent commentary, unusual vocabulary, double meanings, or language that some people may consider inappropriate, provocative, or offensive.

Product descriptions and images are intended to provide customers with reasonable notice of product content before purchasing.

Individual reactions to humor are subjective.

Purchasing a product does not guarantee that you, your relatives, coworkers, neighbors, boss, grandmother, English teacher, or random strangers at the grocery store will approve of the joke.

17. Personal Use

Unless we provide written authorization otherwise, WordSmirk™ products are sold for personal use and legitimate gifting or resale of genuine purchased merchandise where legally permitted.

Purchasing a physical product does not transfer ownership of the underlying artwork, graphics, designs, definitions, trademarks, or other intellectual property.

You may not reproduce WordSmirk™ designs on other merchandise or commercially distribute unauthorized reproductions.

18. User Content

If WordSmirk™ allows you to submit product reviews, photographs, comments, testimonials, suggestions, social-media content, or other materials (“User Content”), you retain any ownership rights you otherwise possess in that content.

By voluntarily submitting User Content to WordSmirk™, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish that content in connection with operating, promoting, and marketing WordSmirk™, subject to applicable law and any specific terms presented when the content is submitted.

You represent that you have the necessary rights to submit the content and that our permitted use will not violate another person's rights.

19. Reviews

Product reviews should reflect genuine experiences and opinions.

We may moderate or remove reviews containing spam, fraudulent content, threats, harassment, unlawful material, personally identifiable information, malicious links, unrelated promotional content, or content that otherwise violates applicable policies or law.

We will not remove legitimate negative reviews merely because they are unfavorable to WordSmirk™.

20. Third-Party Services

WordSmirk™ may rely on third-party providers for services including e-commerce infrastructure, payment processing, product manufacturing, fulfillment, shipping, analytics, advertising, email, SMS, customer service, reviews, and website functionality.

Third-party services may be subject to their own terms, privacy policies, and conditions.

WordSmirk™ is not responsible for the independent acts or omissions of third-party services except to the extent responsibility cannot legally be excluded.

21. Third-Party Links

Our Services may contain links to websites or services operated by third parties.

We do not necessarily control or endorse those websites and are not responsible for their content, availability, privacy practices, security, products, or services.

Accessing third-party websites is at your discretion and may be governed by separate terms.

22. Privacy

Your use of WordSmirk™ is also subject to our Privacy Policy, which explains how personal information may be collected, used, disclosed, and otherwise processed.

WordSmirk™ may use cookies, analytics tools, advertising technologies, and other technologies associated with Shopify, Meta/Facebook/Instagram, Google, and other service providers as described in the Privacy Policy and applicable privacy controls.

23. Prohibited Uses

You may not use WordSmirk™ or its Services to engage in unlawful activity; commit or facilitate fraud; infringe intellectual-property rights; harass or harm others; transmit malicious software; circumvent security features; interfere with website functionality; collect information about other users without authorization; conduct unauthorized automated scraping; place fraudulent orders; misuse promotional programs; impersonate another person; or otherwise materially violate these Terms.

We reserve the right to restrict access to the Services for prohibited conduct where permitted by law.

24. Errors, Inaccuracies and Omissions

Occasionally, WordSmirk™ may contain typographical errors, inaccuracies, omissions, outdated information, or other mistakes concerning product descriptions, pricing, promotions, availability, shipping, or other information.

We reserve the right to correct errors and update information where permitted by law.

If an error materially affects an order you have already placed, we will handle the situation consistent with applicable law.

And yes, a company devoted to obscure words may occasionally make a typo. The irony is not lost on us.

25. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not warrant that the website will always be uninterrupted, error-free, completely secure, or free from harmful components.

Nothing in these Terms excludes warranties, guarantees, or consumer protections that cannot lawfully be excluded.

Product warranties, if any, are subject to applicable law and any specific warranties expressly provided with the product.

26. Limitation of Liability

To the fullest extent permitted by applicable law, WordSmirk™ and its owners, affiliates, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services or purchase of products.

Where permitted by law, our aggregate liability arising from a particular purchase will not exceed the amount you paid to WordSmirk™ for the product or transaction giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

27. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless WordSmirk™ and its owners, affiliates, officers, employees, contractors, agents, licensors, and service providers from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.

This provision does not require indemnification where prohibited by applicable law.

28. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary without affecting the validity and enforceability of the remaining provisions.

29. No Waiver

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

30. Termination

You may stop using WordSmirk™ at any time.

We may suspend or terminate access to the Services when reasonably necessary because of fraud, abuse, unlawful activity, security threats, or material violations of these Terms, subject to applicable law.

Provisions that by their nature should survive termination—including intellectual-property provisions, disclaimers, limitations of liability, and dispute-related provisions—will survive to the extent permitted by law.

31. Governing Law

These Terms and disputes relating to the Services will be governed by the laws of Connecticut/New London County, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Any mandatory rights available to consumers under applicable law remain unaffected.

32. Changes to These Terms

We may revise these Terms periodically to reflect changes to WordSmirk™, our products, technology, business practices, legal requirements, or Services.

The current version will be posted on our website with an updated “Last Updated” date.

Your continued use of the Services after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.

Material changes may be communicated through additional notice where legally required.

33. Entire Agreement

These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, and other policies expressly incorporated by reference, constitute the agreement governing your use of the Services, except where additional terms are expressly provided.
